CONTRACT TERMS AND CONDITIONS
This contract is made between ITALY - WEEKLY - RENTALS di Mario Esposito,
ditta individuale, FORMELLO - ROME, hereinafter called I-W-R, and Mr/Mrs………………hereinafter
called "CLIENT".
I-W-R Agency acts in name and for account of the Owners.
By signing this Booking Contract, the client will be accepting terms and
conditions thereof also on behalf of all members of his party who have
been duly informed by him about the content of this Booking Contract.
2 - BOOKING
The client will immediately mail this contract duly signed to I-W-R address:

Upon receipt of the payment and of this BOOKING CONTRACT duly signed
by the client (faxed copies are accepted) the PROVISIONAL BOOKING become
FINAL.
The client will be sent by I-W-R a final Confirmation of his rental and
an executed copy of this contract. This contract is subject to all conditions
set forth herein and represents the entire agreement of the parties. No
firm Booking Contract will have been made until a duly signed Booking
Contract together with relevant payment as provided upon is submitted
to I-W-R and an executed copy of the contract is issued to the Client
by I-W-R.
3 - CANCELLATION CHARGES
3.1 Alterations and Cancellations by the client:
All payments already effected are not refundable, as specified under item
1 - Availability Confirmation
The client may cancel this Contract at any time before the date of the
signature of the same. Should he later cancel, or the booking is cancelled
by us due to non-payment, cancellation charges will become payable as
follows:
Up to 8 weeks prior to rental date: a charge of 35% of the full contract
price.
Less than 8 weeks prior to rental date: 100% of the full contract price.
I-W-R strongly encourage the client to buy travel insurance at the time
of booking to compensate him in the event he must cancel and forfeit funds.
I-W-R reserves the right to refuse a booking at their discretion. It is
understood that this contract satisfies transitory housing needs only
and that the contract automatically expires at the end of the rental term
as stated on the Booking Form. Neglect to vacate the rental property within
its leased term will automatically result in a daily fine of Euro 200
in addition to the pro-rated rent for occupying the rental property without
a contract. Any renewal of the contract will take place in the offices
of I-W-R or its local representative. In such circumstances, the rental
rate will be re-negotiated, all utilities bills must be paid and a reassessment
of the security deposit will be made.
3.2 Alterations and Cancellations by I-W-R:
Though it is unlikely that I-W-R will have to make any changes to confirmed
arrangements, it does occasionally happen and they will advise the client
at the earliest possible date. If, for any reason beyond I-W-R control,
they are unable to provide the client with the property he have booked,
I-W-R reserve the right to transfer him to a similar property. The price
difference, if greater, must be paid by the client, and, if smaller, will
be reimbursed by I-W-R. If this is not possible or the client does not
wish to be transferred, I-W-R will cancel the booking and refund the amount
paid in full. I-W-R will not be liable for any further obligations or
claims by the client, in particular with travel eventual cancellation
by plane, train or other.
4 - PRICE
The rental price includes power costs, bed linen, swimming pool and garden
services, if any, while heating costs and extra cleaning are to be added,
as specified in the BOOKING FORM. All Extras are specified on the property
listing and are payable to the Owner Euro on arrival/departure or during
client's stay. Those Extras dues are itemized in the item 1-Availability
confirmation. Meters will be read on arrival and departure and the exact
charges will be due on departure. If the client leave without being checked
out as arranged, he risks the forfeiture of his entire Security (see item
8) and/or Utility Deposit. The Owner will deduct the cost of any unpaid
utilities and telephone charges from Security Deposit if the correct amount
is not left in cash on arrival or during client's stage. At most properties,
some staff is included. Additional cleaning service and cook are usually
available by separate payment. If the client arrange in advance for additional
services, he will be responsible for the charges, even if he cancel. Payment
terms are the same as stated above for utilities. The client is recommended
to give I-W-R as much notice as possible for these services.
5 - NUMBER OF PERSONS:
Only those persons listed on the booking request may use the property.
The number of people must not exceed the number of sleeping places indicated
in the property listing except in the case of infants (under two years)
for whom the client bring a travelling cot and linen, or arrange in advance
for this to be available at the property. Pets are not permitted unless
explicitly agreed in writing or in the booking form. Should the key holder
find any violations to this clause, it is totally up to her/his discretion
to ask the client to vacate the house without compensation. Photocopies
of passports for all guests must be provided on arrival.
6 - ARRIVAL AND DEPARTURE TIMES:
The client should arrive between 4pm and 7pm and leave before 10am on
the day of departure unless alternative arrangements have been made in
advance. The client must phone the key holder - phone n. (later) in case
of delay. I-W-R do not guarantee delivery of keys out of these times and
no refund will be made both in case the client could not to take occupation
accordingly and in case he should have to cut short his holiday. I-W-R
recommend to the client to provide arrival details no later than 20 days
before his departure.
7 - SECURITY DEPOSITS:
Security Deposits in Euro, in cash or traveller cheque, is due on every
property to the Owner upon arrival at the rental property. The amount
of each deposit is specified on the Availability confirmation. The client
is responsible for ensuring that the property is left upon departure in
the same condition of cleanliness and repair as upon arrival. The Security
Deposit covers the cost of any damage or breakage during your stay to
the property and its contents, inside and outside, excluding normal wear.
The Property Owner from the Security Deposit will deduct the value of
such damages. The client is required to act in a responsible manner at
all times, and to act with respect towards other guests, the Owners and
their staff. I-W-R reserves the discretionary right, acting in good faith,
to require any individual to vacate a premise for disruptive behaviour
without any refund. Judgement as to the condition of the property is left
to the sole discretion of the Owner. This amount, less any applicable
claims, if any, will be refunded to the client by the Owner upon departure,
after deduction of any extra charges or breakage. Should the damages exceed
the Security Deposit amount, the client agrees to pay the additional charges
on demand.
8 - COMPLAINTS AND LIABILITY:
8.1 - The client and his party hold I-W-R and the property Owner harmless
from and against any and all liability arising out of or in any way connected
with the use and occupancy of the property, including personal injuries,
or death of any customer or his/her family member/ friend, any damages
or losses from fire, theft or criminal activity, no matter however caused.
I-W-R and the property Owner are never liable for consequential damages.
8.2 - You must take all necessary steps to safeguard your personal property
and no liability to you is accepted in respect of damage to, or loss of,
such property, under any circumstances.
8.3 - Statement would read, at the time of your arrival in Italy you are
required to sign a waiver of responsibility form for all minors.
8.4 - Descriptions in the Property Listing are made in good faith. However,
I-W-R decline responsibility for any modifications made by the owners
without knowledge. The owners do not accept responsibility for the breakdown
of the supply of utilities or other essential services such as gas, electricity
and water, over which they have no direct control, though they will use
their best efforts to arrange for these problems to be solved. Such an
inconvenience does not entitle the client to a refund.
8.5 - Should the client have a problem during his holiday he must inform
immediately the owner, the local key holder who will endeavour to put
things right. In serious cases he should call I-W-R. If his complaint
cannot be resolved, he must confirm his complaint in writing to the Owner,
copy to I-W-R within 15 days of vacating the accommodation. It is therefore
a condition of this contract that the client communicates any problem
to I-W-R whilst in resort. If he fail to follow this simple procedure
I-W-R and the Owner cannot accept any responsibility as they have been
deprived of the opportunity to investigate and rectify the problem.
I-W-R cannot guarantee resort facilities will be open in the low season.
Swimming pools are normally only open in the main season.
9 - JURISDICTION:
This contract is governed by the Italian laws. Courts in Italy have exclusive
jurisdiction over any claims, disputes or other matters in question between
the parties.
